Description of Services

Frosthavens provides boutique fitness services including personal training, group fitness classes, specialist fitness programmes, and related wellness services. Our services are designed for individuals seeking professional fitness guidance and support.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice. We may also impose limits on certain features or restrict access to parts of our services.

Membership and Registration

To access our services, you must register for an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 16 years of age to use our services independently. Individuals under 18 require parental or guardian consent. We reserve the right to refuse service to anyone at our discretion.

Health and Safety Requirements

You acknowledge that participation in fitness activities involves inherent risks and that you participate at your own risk. You represent that you are in good health and have no medical conditions that would prevent safe participation in our programmes.

You agree to:

• Disclose any health conditions, injuries, or medications that may affect your ability to exercise safely
• Obtain medical clearance before participating if you have any health concerns
• Follow all safety instructions and guidelines provided by our staff
• Use equipment properly and report any defects or hazards immediately
• Respect the health and safety of other members and staff

User Conduct and Obligations

You agree to use our services responsibly and in accordance with these Terms. You will not:

• Engage in any behaviour that is disruptive, offensive, or inappropriate
• Use our facilities under the influence of alcohol or illegal substances
• Damage or misuse our equipment, facilities, or property
• Violate any applicable laws or regulations
• Harass, intimidate, or discriminate against other members or staff
• Use our services for any commercial purpose without our written consent
• Share your account access with unauthorised individuals

We reserve the right to suspend or terminate your membership for violation of these conduct standards.

Payment Terms and Cancellation

Payment for services is due at the time of booking or as specified in your membership agreement. We accept various payment methods as displayed during the booking process. All prices are in Euros and include applicable VAT.

Cancellation policies vary by service type:

• Personal Training: 24 hours' notice required for cancellation or rescheduling
• Group Classes: 12 hours' notice required
• Programmes: Specific terms outlined in your programme agreement

Late cancellations or no-shows may result in forfeiture of the session. Refunds are provided according to our refund policy, available upon request.

Intellectual Property

All content, materials, and intellectual property associated with Frosthavens, including but not limited to logos, trademarks, text, images, software, and training programmes, are owned by or licensed to Frosthavens and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our intellectual property without our express written permission. Any unauthorised use may result in immediate termination of your access to our services and legal action.

You retain ownership of any personal information you provide to us, subject to our Privacy Policy. By using our services, you grant us a limited licence to use your information as described in our Privacy Policy.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

We may use photographs or videos taken during sessions or classes for promotional purposes. If you prefer not to be included in such materials, please inform us in writing.

Limitation of Liability

To the fullest extent permitted by law, Frosthavens, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to:

• Personal injury or property damage
• Loss of profits, data, or business opportunities
• Interruption of services or equipment malfunction
• Actions or omissions of other members or third parties

Our total liability to you for any claim arising from these Terms or your use of our services shall not exceed the amount you have paid to us for services in the 12 months preceding the claim.

This limitation of liability does not affect any statutory rights that cannot be excluded or limited by law.

Indemnification

You agree to indemnify, defend, and hold harmless Frosthavens, its directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

• Your use of our services or facilities
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Any injury or damage caused by your actions or negligence

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the Irish courts.

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

Termination

Either party may terminate your access to our services at any time, with or without cause, by providing written notice. Upon termination:

• Your right to use our services will cease immediately
• You remain liable for all charges incurred prior to termination
• Prepaid but unused services may be refunded according to our refund policy
• All provisions that by their nature should survive termination shall continue in effect

We reserve the right to immediately terminate access for violations of these Terms, safety concerns, or illegal activities.

Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, government actions, pandemics, or other emergencies.

These Terms, together with our Privacy Policy and any specific programme agreements, constitute the entire agreement between you and Frosthavens regarding your use of our services and supersede all prior agreements and understandings.
